Overview of the team and role

The Legal Advice and Strategy team provides legal advice to Comcare on the general interpretation and development of all Comcare legislation, including the Work Health and Safety Act 2011 (WHS Act), Safety, Rehabilitation and Compensation Act 1988 (the SRC Act), the Seacare Act and other public sector related legislation.

The team also provides legal advice and support on a broad range of matters including but not limited to corporate operations such as procurement and general commercial law, and governance issues relating to Comcare.

The team provides assistance to Comcare to support the Safety, Rehabilitation and Compensation Commission (SRCC), the Seacare Authority, including support with managing claims against the Seacare fund, and provides legal support for Comcare’s governance and corporate operations more broadly. 

The Senior Legal Adviser supports the Principal Legal Adviser in performing their role and provides client-focused high level, specialist legal and strategic advice and support to Comcare staff on very complex or sensitive legislative, regulatory, policy and procedural matters. 

The Senior Legal Adviser will resolve problems and manage risk effectively and manage their own workload in a manner consistent with the APS Values and Code of Conduct, the Legal Services Directions 2017, and internal Comcare procedures.

Providing high level leadership and management, the Senior Legal Adviser will achieve organisational objectives through successful planning and participating, contributing and collaborating within large teams. The work includes:

  • legal research, analysis and evaluation, preparing reports, conducting litigation and providing advice on very complex and / or sensitive issues,
  • nurturing complex relationships with internal and external stakeholders including clients, service providers, licensees and premium payers, 
  • supervision, quality assurance, training, support and development of other team members, and
  • initiating and driving continuous improvement and managing change.

Mandatory Qualifications/Experience

  • Undergraduate degree in law.
  • Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory (five years or more post admission experience is desirable).
  • Current Practising Certificate or ability to obtain one within three months.
